RECOGNATION PRIVACY STATEMENT

This Privacy Statement describes how RecogNation, LLC (“Company” “we” or “us”) collects, handles and processes personally identifiable information including non-public personal information we obtain regarding individuals (“personal information”) in connection with your access or use of all of the websites (“Sites”) and services, products, applications offered by the Company (“Services”).

Please read this Privacy Statement carefully to understand our policies and practices regarding your personal information and how we will treat it. If you do not agree with our policies and practices, your choice is to not access or use our Services or Sites or provide any information in connection with them. By accessing or using our Services or Sites or providing any information in connection with them, you agree to this Privacy Statement. You also expressly consent to the processing of your personal information according to this Privacy Statement.

Information Collected by the Company

The Company may collect or receive information about you, including:

  • your name, company name, address, birthdate, city, state and ZIP code, email address and telephone number.
  • your organizational and employment information that includes job title, work location and hire date.
  • your device data and how you interact with the Company’s Sites (e.g., IP address, browser type, and unique device identifier).
  • details of any redemption transactions you carry out through the Services.

We obtain the categories of personal information listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete, Services you utilize or products you redeem directly from us.
  • Indirectly from you. For example, from observing your actions on the Sites or on other Sites which employ our cookies.
  • From our business customers. We receive your personal information when performing our Services on behalf of our business customers.
  • To fulfill or meet the reason you provided the information. For example, if you share your name and contact information to ask a question about our products, we will use that personal information to respond to your inquiry. If you provide your personal information to redeem a product, we will use that information to facilitate the transaction. We may also save your information to facilitate new product orders;
  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses or to investigate fraud;
  • To help maintain the safety, security, and integrity of our Sites, products, databases and other technology assets, and business;
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations;
  • As described to you when collecting your personal information;
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about our consumers is among the assets transferred.
  • with banks and credit card processors to the extent necessary for the Company to deliver the Services.
  • in certain instances, when we have reason to believe that it is necessary to identify, contact, or bring legal action against persons or entities which may be causing injury to you, to the Company, or to others, or when we believe the law requires it. For instance, in response to a lawsuit request by public authorities, including to meet national security or law enforcement requirements.

Data we receive from other sources may be combined with the information you provide us and may be used or shared for the following purposes stated below.

Use of Personal Information

We may also use or disclose the personal information we collect for one or more of the following purposes:

In connection with personal information we receive from our customers in connection with our performance as a service provider, we will (i) keep the personal information strictly confidential; (ii) use, retain and disclose the personal information only for the purposes for which our customers provide such personal information, and not otherwise disclose, retain or make available the personal information for our own purposes; provided, however, that we may aggregate, de-identify or anonymize the personal information and use such aggregated, de-identified or anonymized data, which shall no longer be considered personal information, for our own research and development purposes; and (iii) not disclose such personal information to any third party, other than third-party contractors who have a need to know such personal information for the purpose of effectuating the sale and maintenance of the Services, and who are bound by a confidentiality agreement with the Company with terms at least as restrictive as those contained in this Privacy Statement.

We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

The Company’s Sharing of Information Collected

We may transfer personal information to our third-party agents, affiliates, contractors, or service providers who perform functions on our behalf. Where required by the Privacy Shield, we enter into written agreements with those third-party agents and service providers requiring them to provide the same level of protection the Privacy Shield requires and limiting their use of the data to the specified services provided on our behalf. We take reasonable and appropriate steps to ensure that third-party agents and service providers process personal information in accordance with the EU-U.S. Privacy Shield Framework and the Swiss-U.S. Privacy Shield Framework (“Privacy Shield”) obligations and to stop and remediate any unauthorized processing. Under certain circumstances, we may remain liable for the acts of our third-party agents or service providers who perform services on our behalf for their handling of personal information that we transfer to them.

Apart from the categories and purposes listed above, the Company will not share your personal information with other third parties for their independent use without your permission. The Company will provide an individual opt-out choice before we share their data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. To limit the use and disclosure of your personal information, you may submit a written request to support@recognation.com. The Company shall only collect and use personal information in a way that is compatible with and relevant for the purpose for which it was collected or authorized by the individual.

You have the choice to be excluded from our offers and promotions and to be excluded from sharing personal information for marketing purposes. Please be sure to include your email address, full name, and specifically what information you do not want to receive, such as “no phone offers,” “no mail offers,” “no email offers,” or “no sharing of information with partners.” We will respond to requests within a reasonable time.

Updating, Correcting, and Deleting Information About You

You have the right to obtain our confirmation of whether we maintain personal information relating to you. Upon request, we will provide you with access to the personal information that we hold about you. You may also may correct, amend, or delete the personal information we hold about you. If you would like to access, or who seeks to correct, amend, or delete inaccurate data, please let us know by calling us at 1-888-919-7600 or by sending us an email at support@recognation.com. If requested to remove data, we will respond within a reasonable timeframe. Please be sure to include your email address, full name, and specifically what information you would like to update or correct. Please remember, if you delete certain information, you may not be able to continue to redeem products or access other portions of our Site without entering additional information.

Your right to access your personal information may be restricted in exceptional circumstances, including, but not limited to, when the burden or expense of providing this access would be disproportionate to the risks to your privacy in the case in question, or when the rights of persons other than you would be violated by the provision of such access. If we determine that your access should be restricted in a particular instance, we will provide you with an explanation of our determination and respond to any inquiries you may have.

Cookies/Tracking Technologies

Our Sites may use “cookies” and other tracking technologies to gather information about your interactions. This information may include demographic data, browser type, IP address, pages visited, activities conducted on the page, and the day and time of your visit. We do not currently honor “do not track” signals from a web site browser. Please refer to your computer browser help instructions for more information on cookies and other related technologies and how to manage their use. If you refuse or delete cookies, you will need to repeat the process if you use another computer or change browsers. If you refuse or delete cookies, some of the functionality of our Sites could potentially be impaired.

Pages of our Sites may also contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that allow us, for example, to count users who have visited those pages. We may use this information to provide a better website user experience, and tailor our marketing communications.

Security and Retention

Safeguarding personal information is important to us. Once we receive your transmission, we will do our best to protect its security on our systems. We restrict access to personal information about you to those employees who need to know that information to provide products or Services to you. We maintain physical, electronic, and procedural safeguards to guard your personal information. We retain your personal information only as long as we need it for the purposes for which it was originally collected or for other legitimate purposes (such as regulatory compliance), or as permitted by applicable law. We will also retain and use your personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. If we do not have a legal basis for retaining your information, we will delete it as required by applicable law.

Data Privacy Framework

RecogNation, LLC complies with the EU-U.S. Data Privacy Framework program (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework program (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce.  RecogNation, LLC has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) in reliance on the UK Extension to the EU-U.S. DPF.  RecogNation LLC has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework program Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF.  If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern.  To learn more about the Data Privacy Framework (DPF) program, and to view our certification, please visit https://www.dataprivacyframework.gov/.

Cross-Border Data Transfers

Because the European Union Commission has determined that certain countries data privacy laws including the United States do not ensure an adequate level of protection for personal information collected from EU data subjects, any such transfers by RecogNation to these countries will generally be subject to appropriate additional safeguards under standard data protection clauses adopted by the EU Commission or adopted by a supervisory authority and approved by the EU Commission. Our Sites may contain links to other websites. The Company assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. You expressly relieve the Company from any and all liability arising from your use of any third-party website, or from the content of any third-party website.

Children’s Privacy

Our Sites or Services do not target or knowingly collect any information from individuals under the age of 18. If you believe that we have received information from a child or minor, please notify us immediately by calling us at 1-888-919-7600 or by sending us an email at support@recognation.com.

Recourse, Enforcement, and Liability

The Company uses a self-assessment approach to assure compliance with this Privacy Statement and periodically verifies that the Privacy Statement is accurate, comprehensive for the information intended to be covered, prominently displayed, completely implemented and accessible, and in conformity with the Principles. The Company is subject to the investigatory and enforcement powers of the Federal Trade Commission (FTC). We encourage you to raise any concerns using the contact information provided, and we will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of personal information in accordance with the Principles.

Binding Arbitration

Changes to our Privacy Statement

It is our policy to post any changes we make to our Privacy Statement on this page with a notice that the Privacy Statement has been updated on our Site home pages. If we make material changes to how we treat our users’ personal information, we will notify you through a prominent notice on our Site home pages in addition to any legal requirements. The date the Privacy Statement was last revised is identified at the top of the page. We expressly reserve the right to amend this Privacy Statement from time to time consistent with the Privacy Shield’s requirements.

About California Proposition 65

California’s Proposition 65 entitles California consumers to special warnings for products that contain one or more of the approximately 950 common substances known to the state of California to cause cancer and birth defects or other reproductive harm if those products expose consumers to such chemicals above certain threshold levels. This law also states that any company that delivers these products to addresses in California MUST place a warning on the product, usually in the form of a sticker. We care about our customer’s safety and are providing the following warning for products linked to this page:

What Is the Risk Level?

A person exposed to the chemical at the “no significant risk level” for 70 years would not have more than a “one in 100,000” chance of developing cancer because of that exposure.

If you are a vendor contracted by Baudville, Inc, we request that you try to incorporate raw or component materials that meet the Phthalate Free concentration standards that adhere to less than or equal to 1,000 parts per million (“ppm”) of DEHP, DBP, DINP, DIDP, DnHP, and BBP as determined by a minimum of duplicate quality controlled test results using Environmental Protection Agency (“EPA”) testing methodologies 3580A and 8270C.
